Welcome to Scrambled Eggs ("Scrambled Eggs", "we", "us", or "our"). These Terms of Service ("Terms") form a binding agreement between you and Scrambled Eggs governing your use of the Scrambled Eggs mobile application and any related services (collectively, the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you confirm that a parent or legal guardian has read and accepted these Terms on your behalf. You also agree to comply with the rules of the App Store from which you downloaded the App.

2. Your account

You are responsible for keeping your account credentials secure and for any activity that occurs under your account. You agree to provide accurate information when signing up and to keep it up to date. We may suspend or terminate accounts that violate these Terms.

3. Subscriptions, billing, and free trials

The App offers paid subscriptions ("Scrambled Pro") that unlock additional features. Subscriptions are sold and billed through your Apple ID via the App Store.

Pricing. Current prices are displayed in the App before purchase. Prices may vary by region and may change from time to time. Any price change will not apply to your existing subscription term but will take effect on renewal.

Free trial. If a free trial is offered, you will not be charged during the trial period. To avoid being charged, you must cancel at least 24 hours before the trial ends. Cancelling during the trial keeps access through the end of the trial period.

Auto-renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged at confirmation of purchase and at each renewal.

Managing and cancelling. You can view, manage, or cancel your subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions on iOS). Deleting the App does not cancel your subscription.

Refunds. All payments are processed by Apple. Refund requests are handled by Apple in accordance with the App Store's refund policy: https://support.apple.com/HT204084. We are unable to issue refunds directly.

4. Licence to use the App

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, solely for your personal, non-commercial use, and subject to these Terms. All intellectual property in the App belongs to Scrambled Eggs or its licensors.

5. Your content and data

You retain ownership of the scores, round information, team rosters, and other content you create in the App ("Your Content"). You grant us a worldwide, royalty-free, non-exclusive licence to host, store, copy, transmit, and display Your Content as necessary to operate the App and provide the service to you and your teammates.

You are responsible for Your Content and for the consent of any people you add as players or teammates (for example, ensuring guest players consent to having their name and scores recorded).

6. Acceptable use

You agree not to:

use the App for any unlawful purpose or in breach of any applicable law;
attempt to reverse engineer, decompile, or interfere with the App's normal operation;
upload content that is defamatory, harassing, hateful, infringing, or otherwise objectionable;
impersonate another person or misrepresent your affiliation with any person or organisation;
attempt to gain unauthorised access to the App, other users' accounts, or our systems;
use the App in a way that interferes with other users or degrades service for others.

We may suspend or terminate your account for breach of these acceptable-use rules without notice.

7. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://scrambledeggs.golf/privacy. The Privacy Policy explains what data we collect, how we use it, and your rights in relation to that data.

8. Third-party services

The App integrates with third-party services including Apple (account, in-app purchases), Google (sign-in), Supabase (data storage), and RevenueCat (subscription management). Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Service availability

We aim to keep the App available and working but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the App, or any part of it, at any time with or without notice. We are not liable for any loss arising from changes to or unavailability of the App.

10. Disclaimers

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or that defects will be corrected.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other legislation that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, Scrambled Eggs is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the App.

Our total liability to you for any claim arising out of or in connection with these Terms or the App will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) AUD $50.

12. Indemnity

You agree to indemnify and hold Scrambled Eggs harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the App, or Your Content.

13. Termination

You may stop using the App at any time. You may delete your account from within the App (Profile → Delete Account) — this removes your personal data and rounds in accordance with our Privacy Policy.

We may suspend or terminate your access at any time, with or without notice, for breach of these Terms or if continued provision of the App becomes impractical. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the latest version. Material changes will be notified through the App or by email. Continued use of the App after a change takes effect constitutes your acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Victoria, Australia. You and Scrambled Eggs submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia for any dispute arising out of or in connection with these Terms.

16. Apple-specific terms

If you obtained the App from the Apple App Store, you acknowledge:

These Terms are between you and Scrambled Eggs, not Apple. Apple is not responsible for the App or its content.
Your licence to use the App is limited to use on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.
Apple has no obligation to provide maintenance or support for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims relating to the App or your use of it, including product liability, consumer protection, or intellectual property claims.
In the event of any third-party claim that the App infringes that party's intellectual property rights, Scrambled Eggs (not Apple) will be solely responsible for the investigation, defence, settlement, and discharge of that claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
